オートハーモニック使用許諾契約書
重要 - 以下の契約書をご確認ください。
本使用許諾契約書 (以下「本契約書」といいます) は、オートハーモニック (以下「本ソフトウェア」といいます) に関してお客様 (個人または法人のいずれであるかを問いません) とファム社 (以下「ファム」といいます) との間に締結される法的な契約書です。本ソフトウェアをダウンロード、インストール、複製、または使用することによって、お客様は本契約書の条項に拘束されることに同意されたものとします。本契約書の条項に同意されない場合は、本ソフトウェアをダウンロード、インストール、複製、または使用することはできません。
1. ライセンスの許諾
本ソフトウェアは、ライセンスされるものであって、売り渡されるものではありません。また本ソフトウェアの使用には時間制限が付けられていることがあります。本ソフトウェア、付随する印刷資料および本書によってお客様に許諾された一切のコピーのタイトルと著作権は、ファム またはその提供者が所有し、日本および米国の著作権法ならびに国際条約の条項によって保護されています。したがって、お客様は、本ソフトウェアを他の著作物（例：書籍や音楽録音）と同様に取り扱わなければなりません。ただし、お客様は（ａ）バックアップまたは保存目的でのみ本ソフトウェアのコピーを 1つ作ること、または（ｂ）本ソフトウェアを 1つのハードディスクに移し、オリジナルをお客様がバックアップまたは保存目的でのみ保有することのいずれかをすることができます。お客様は、本ソフトウェアに付随する印刷資料をコピーすることはできません。ファムは、お客様が本契約書のすべての条項を厳守することを条件として、お客様に対し以下の権利を許諾します。
1.1 インストールおよび使用 お客様は、パーソナル コンピュータまたはその他のデバイスに本ソフトウェアのコピーを数に限りなくインストールして使用することができます。
1.2 ドキュメントに関するライセンスの許諾 本ソフトウェアに付属しているドキュメントは、内部的に非商業目的で参照する場合に限り、使用することができます。
3. 権利および所有権の留保 ファムは、本契約書においてお客様に明示的に許諾されていない権利をすべて留保します。本ソフトウェアは、著作権およびその他の知的財産権に関する法律および条約によって保護されています。ファムまたはその供給者は、本ソフトウェアに含まれる権原、著作権、およびその他の知的財産権を有します。本ソフトウェアは許諾されるものであり、販売されるものではありません。本契約書は、お客様にファムの商標またはサービス マークに関連した権利を許諾するものではありません。
4. リバース エンジニアリング、逆コンパイル、逆アセンブルの制限 お客様は、本ソフトウェアをリバース エンジニアリング、逆コンパイル、または逆アセンブルすることはできません。
5. レンタル/商用ホスティングの禁止 お客様は本ソフトウェアをレンタル、リースまたは貸与することはできません。
6. データ使用に関する承諾 お客様は、ファムおよびその関連会社が本ソフトウェアに関してサポート サービスを提供する場合、その一環として技術情報を収集、使用することがあることに同意するものとします。ファムは製品の向上のため、またはお客様にカスタマイズされたサービスや技術を提供するためにのみ、かかる技術情報を使用できるものとします。この情報がお客様個人を特定できる形で公開されることはありません。
7. 第三者のサイトへのリンク ファムは、第三者のサイトおよびサービスの内容、第三者のサイトおよびサービスに含まれるリンク、およびそれらの変更や更新について責任を負いません。これらのリンクおよびアクセスは、お客様の利便性を考慮して提供されているものであり、ファムがその第三者のサイトおよびサービスの内容を推奨していることを意味するものではありません。
8. 追加のソフトウェア/サービス 本ソフトウェアをお客様が最初に入手したとき以降にファムがお客様に提供する、または利用可能にするアップデート、機能追加、アドオン コンポーネント、またはインターネット ベースのサービス コンポーネントに対しても、それらに他の条項が付属していない限り、本契約書が適用されます。ファムは、本ソフトウェアの使用を通じてお客様に提供しているインターネット ベースのサービスを、中止する権利を留保します。
9. 契約の終了お客様が本契約書に違反した場合、ファムは、他の権利を害することなく、本契約書を終了することができます。その場合、お客様は本ソフトウェアの複製物およびその構成部分をすべて破棄しなければなりません。
10. 準拠法 本契約書は、日本国法に準拠するものとします。
11. 完全合意、分離可能性 本契約書 (本ソフトウェアに付属する本契約書への追加条項または修正条項を含む) は、本ソフトウェアならびにサポート サービス（該当する場合）についてのお客様とファムとの間の完全なる合意であり、本ソフトウェア、または本契約書が適用されるその他の内容に関してのすべての以前の口頭または書面による意思表示、提案、表明よりも優先して適用されます。サポート サービスに関するファムのポリシーまたはプログラムに定められた条項と本契約書の条項との間に不一致がある場合、本契約書の条項が優先して適用されるものとします。本契約書の一部の条項が無効となったり、法的な強制力を失ったり、あるいは非合法と判断された場合でも、その他の条項には影響を与えることなく完全に有効性が保たれるものとします。
品質保証規定
以下の保証規定は、ファム社（以下「ファム」といいます）の本ソフトウェアに関する品質保証規定です。本規定は、お客様が本ソフトウェアを入手された国や地域に関わらず適用されます。お客様は、全くエラーのないソフトウェアというものはありえないものであることをご了承の上で本ソフトウェアをご使用になるものとます。
その他の保証の排除－ファムは、明示たると黙示たるとを問わず、本ソフトウェアおよびサポート サービスについて、上記の保証以外にはいかなる保証（瑕疵担保責任などの法律上の責任を含みますが、これに限定されません）もいたしません。かりに本条で除外できない保証責任が存在したとしても、かかる保証責任は、お客様が本ソフトウェアを入手された日から90日間のみ存続するものとします。
責任の限定‐本保証規定において規定される場合を除き、ファムおよびその供給者は、本ソフトウェアの使用もしくは使用不能から生じるいかなる損害（事業利益の喪失、事業の中断、事業情報の喪失その他の金銭的損失についての損害を含みますが、これらに限定されません）に関しても、一切責任を負いません。たとえ、ファムがかかる損害の可能性について知らされていた場合でも同様です。本保証規定または使用許諾契約書の下で生じるファムおよび供給者の責任は、法律上除外が認められない場合を除き、本ソフトウェアについてお客様が実際に支払った金額を上限とします。
本ソフトウェアを日本で入手された場合、本保証規定は日本国法に準拠するものとします。ただし、欧州連合諸国、アイスランド、ノルウェー、スイス、韓国で入手された場合は各地域の法律が適用され、その他の国で入手された場合は米国ワシントン州法に準拠するものとします。
本保証規定は、法律上無効とされない限度でその効力を有するものであり、仮に、本保証規定の一部の条文が無効と判断された場合においても、残りの条文は引き続き有効であるものとします。
ライセンス認証につきまして（2026年4月27日）
当検知ツールは、ご利用者の方ができるだけ柔軟にツールを活用できるよう、個別ライセンスによる利用認証の手続きは行っておりません。
ご自身の名義であれば、複数台・複数アカウントでのご利用も、すべて自由です。
そのかわりに、ソフトウェアのライセンスを保護するため、毎年末に当講義内から翌年末まで利用可能なファイルを入手していただき、ご自身で更新をしていただいております。
年末前には当講義内に更新されたファイルをアップロードを行い、通知メールをお送り致します。
※ 迷惑メールフォルダに仕分けされるケースも頻発するため、メール未着の際にはコース内の【ダウンロード】と記載された講義を訪問してみてください。
なお、旧ファイルは期日到来後にパターンの検知を行わなくなります。（ブローカーによっては月末日直前から利用できなくなる場合があります）

Terms of Use
Auto Harmonic Software License Agreement
IMPORTANT — Please review the following agreement carefully.
This Software License Agreement (the “Agreement”) is a legal agreement between you (whether an individual or a legal entity) and Fam Corp. (“Fam”) with respect to Auto Harmonic (the “Software”). By downloading, installing, copying, or using the Software, you agree to be bound by the terms of this Agreement. If you do not agree to these terms, you may not download, install, copy, or use the Software.

1. Grant of License
The Software is licensed, not sold. Use of the Software may be subject to time limitations. Title and copyright to the Software, accompanying printed materials, and all authorized copies are owned by Fam or its suppliers, and are protected by the copyright laws of Japan and the United States, as well as international treaty provisions. You must treat the Software like any other copyrighted material (e.g., a book or music recording). You may either (a) make one copy of the Software solely for backup or archival purposes, or (b) transfer the Software to a single hard disk, provided you keep the original solely for backup or archival purposes. You may not copy the printed materials accompanying the Software. Subject to your strict compliance with all terms of this Agreement, Fam grants you the following rights:
1.1 Installation and Use
You may install and use an unlimited number of copies of the Software on personal computers or other devices.
1.2 Documentation License
Documentation included with the Software may be used solely for internal, non-commercial reference purposes.

3. Reservation of Rights and Ownership
Fam reserves all rights not expressly granted to you under this Agreement. The Software is protected by copyright laws and other intellectual property laws and treaties. Fam or its suppliers hold all title, copyright, and other intellectual property rights in the Software. The Software is licensed, not sold. This Agreement does not grant you any rights in connection with any trademarks or service marks of Fam.

4. Restrictions on Reverse Engineering, Decompilation, and Disassembly
You may not reverse engineer, decompile, or disassemble the Software.

5. Prohibition on Rental / Commercial Hosting
You may not rent, lease, or lend the Software.

6. Consent to Use of Data
You agree that Fam and its affiliates may collect and use technical information as part of any support services provided in connection with the Software. Fam may use such technical information solely to improve its products or to provide customized services and technologies to you. This information will not be disclosed in a form that personally identifies you.

7. Links to Third-Party Sites
Fam is not responsible for the content of third-party sites and services, the links contained within those sites and services, or any changes or updates to them. These links and access are provided for your convenience only and do not constitute an endorsement by Fam of any third-party site or service.

8. Additional Software / Services
This Agreement also applies to any updates, feature additions, add-on components, or Internet-based service components that Fam may provide or make available to you after you first obtain the Software, unless such items are accompanied by separate terms. Fam reserves the right to discontinue any Internet-based services provided to you through your use of the Software.

9. Termination
Without prejudice to any other rights, Fam may terminate this Agreement if you fail to comply with any of its terms and conditions. In such event, you must destroy all copies of the Software and all of its component parts.

10. Governing Law
This Agreement shall be governed by the laws of Japan.

11. Entire Agreement; Severability
This Agreement (including any addenda or amendments included with the Software) constitutes the entire agreement between you and Fam with respect to the Software and any applicable support services, and supersedes all prior or contemporaneous oral or written communications, proposals, and representations relating to the Software or any other subject matter covered by this Agreement. In the event of any conflict between the terms of this Agreement and any Fam policy or program for support services, the terms of this Agreement shall control. If any provision of this Agreement is held to be void, unenforceable, or illegal, the remaining provisions shall continue in full force and effect.

WARRANTY PROVISIONS
The following warranty provisions set forth Fam Corp.’s (“Fam”) quality assurance terms with respect to the Software. These provisions apply regardless of the country or region in which you obtained the Software. You acknowledge that no software is entirely free of errors and agree to use the Software on that basis.
Disclaimer of Other Warranties
Fam makes no warranties, express or implied, with respect to the Software and support services beyond those stated above, including but not limited to any warranties arising under law. To the extent any such warranty cannot be excluded by law, such warranty shall survive for a period of ninety (90) days from the date on which you obtained the Software.
Limitation of Liability
Except as provided in these warranty provisions, Fam and its suppliers shall not be liable for any damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or other pecuniary loss) arising out of the use of or inability to use the Software, even if Fam has been advised of the possibility of such damages. Fam’s and its suppliers’ total liability under these warranty provisions or the license agreement shall not exceed the amount actually paid by you for the Software, except to the extent such limitation is prohibited by applicable law.
If you obtained this Software in Japan, these warranty provisions shall be governed by the laws of Japan. If obtained in a European Union member state, Iceland, Norway, Switzerland, or Korea, the laws of the applicable jurisdiction shall apply. If obtained in any other country, the laws of the State of Washington, U.S.A. shall apply.
These warranty provisions shall be effective to the extent not invalidated by law. If any provision is held to be invalid, the remaining provisions shall remain in full force and effect.

License Activation Notice (April 27, 2026)
In order to give users maximum flexibility, this detection tool does not require individual license authentication.
You are free to use the Software across multiple devices and multiple accounts, as long as all use remains under your own name.
In place of individual authentication, the Software is protected through an annual file renewal system. Near the end of each year, an updated file valid through the end of the following year will be uploaded to this course. You will also receive a notification email at that time.
Please note that spam filters may redirect notification emails to your junk folder. If you do not receive an email, please visit the lecture labeled [Download] within the course to obtain the latest file.
The previous year’s file will stop detecting patterns after its expiration date. Depending on your broker, the file may become inactive shortly before the last day of the month.
